This Health and Safety Waiver (the “Waiver”) is a legally binding document that ensures all participants in any activities organized by SayPro, whether online or in-person, are cleared for participation, and fully aware of their responsibilities regarding health and safety protocols. This Waiver is to be signed by all participants prior to engaging in any activities, whether those activities are hosted virtually, in-person, or through a hybrid format.

1. Participant’s Acknowledgement of Health and Safety Risks

By signing this Waiver, the participant acknowledges that they understand the inherent risks associated with both online and in-person activities. For in-person activities, these risks may include potential exposure to illnesses, injuries, or accidents that could occur during the course of the event. For online activities, participants acknowledge potential risks related to technological failures, cyber security concerns, or misuse of personal data.

Participants are responsible for reviewing and understanding the health and safety protocols applicable to the specific activities in which they are involved. This includes any safety measures implemented by SayPro, including but not limited to social distancing, mask requirements, sanitization protocols, and other public health guidelines.

2. Health Condition Declaration

By signing this Waiver, the participant affirms that they are in good health and capable of safely participating in the activity. If the activity is in-person, the participant must declare that they do not have any conditions that would compromise their safety or the safety of others, including but not limited to the following:

– Any contagious illness (e.g., flu, cold, COVID-19, etc.)
– Any known allergies or physical conditions that might limit participation
– Any previous injuries that may be aggravated by physical activity

If at any point prior to, during, or after the activity the participant experiences any symptoms of illness, or if they are diagnosed with a contagious illness, they agree to immediately inform SayPro and refrain from participating until they are cleared to do so by a medical professional.

3. COVID-19 and Other Contagious Illnesses (For In-Person Events)

In the context of in-person activities, participants acknowledge the ongoing risks associated with contagious diseases, including COVID-19. The participant agrees to adhere to any COVID-19 related safety measures, which may include wearing face coverings, maintaining physical distance, undergoing health screenings, or any other protocol put in place by SayPro.

Participants further agree to:

– Immediately inform SayPro if they have recently been in contact with anyone who has tested positive for COVID-19 or shown symptoms.
– Refrain from attending in-person events if they have any symptoms of illness.
– Follow all instructions provided by SayPro regarding safety measures, such as sanitization and physical distancing.

SayPro reserves the right to refuse participation to any individual who does not comply with the health and safety measures or who exhibits symptoms of illness.

4. Medical Emergencies (For In-Person Events)

In the event of an emergency, the participant grants permission for SayPro staff or event coordinators to seek medical treatment on their behalf if necessary. The participant acknowledges that they are responsible for any medical expenses incurred during their participation, and they agree to release SayPro from any liability related to medical care, treatment, or any resulting injuries.

5. Online Activity Safety

For online events or activities, the participant agrees to use appropriate devices, software, and secure internet connections. SayPro is not responsible for any technological failures or losses that occur due to issues on the participant’s end, such as device malfunctions, connectivity issues, or cyber security threats.

By signing this Waiver, the participant acknowledges that they understand and accept the risks involved with participating in virtual activities. This includes potential risks related to privacy, security breaches, and any unintentional exposure of personal information during online sessions or through virtual interactions.

6. Participant Code of Conduct

Participants in both in-person and online activities are expected to adhere to a respectful and professional code of conduct. This includes but is not limited to:

– Respecting the rights, privacy, and dignity of others.
– Following all health and safety instructions provided by event organizers, facilitators, or staff members.
– Refraining from disruptive behavior or any activity that would put others at risk.

Failure to comply with these terms may result in termination of participation in the activity, without refund or further recourse.

7. Waiver of Liability

By signing this Waiver, the participant agrees to waive any and all claims against SayPro, its employees, contractors, or affiliates for any injury, loss, or damage sustained as a result of participation in any SayPro activity. This includes but is not limited to:

– Physical injuries sustained during in-person activities.
– Health complications resulting from exposure to illnesses.
– Emotional distress or damage due to online interactions.
– Technological disruptions or data breaches in online activities.

This waiver applies to all foreseeable and unforeseeable risks associated with participating in SayPro’s activities, whether or not those risks were identified by the participant at the time of signing this Waiver.

8. Indemnification

The participant agrees to indemnify, defend, and hold harmless SayPro and its affiliates from any and all claims, liabilities, damages, or expenses arising from their participation in the activity. This includes claims made by third parties related to injuries, losses, or damages resulting from the participant’s actions during the event.

9. Consent to Photography and Recording

By participating in any activity hosted by SayPro, participants consent to being photographed, recorded (audio or video), and having such materials used in promotional or educational materials by SayPro. If a participant does not wish to be photographed or recorded, they must inform SayPro staff prior to the event.

10. Participant’s Acknowledgement and Signature

By signing below, the participant acknowledges that they have read, understood, and agreed to the terms of this Health and Safety Waiver. The participant also affirms that they are of legal age or have obtained parental/guardian consent if they are a minor. The participant understands that they may withdraw from participation at any time, but that the terms outlined in this waiver will still apply.
